Not all Phase I reports are created equal. Sometimes it can be difficult to tell the good from the not so good and the bad. At minimum a Phase I ESA should be performed to the most-current Phase I ESA standard (ASTM E1527-13). Contains clear summaries of Recognized Environmental Conditions (RECs), Historical RECs (HRECs), Controlled RECs (CRECs). Uses the correct terminology correctly. Includes discussion of Vapor Encroachment. And lastly has no “loose ends” or internal contradictions within the document.

If you plan to purchase or finance a commercial property without performing a Phase I Environmental Site Assessment (ESA), you very likely will be responsible for any contamination or clean up of the property.  If you have a Phase 1 ESA performed following ASTM-E-1527-13, this “due diligence” process will relieve you of the clean-up or restoration of the property either by placing the responsibility on the original owner or it can be covered under the Superfund.
